ABUSE-FREE SPORT REGISTRY TERMS AND CONDITIONS OF USE

By accessing and using Abuse-Free Sport Registry (the "Registry"), YOU agree to the following terms and conditions. If YOU do not agree, you may not access or use this Registry.

By using the Registry, YOU consent and agree to any and all the following terms and conditions and expressly hereby release, waive and forever discharge the Sport Dispute Resolution Centre of Canada ("SDRCC") (on its own behalf and on behalf of the OSIC) (including but not limited to their employees, agents, directors, legal successors/assigns, and affiliates), both jointly and severally, from all actions, suits, claims and demands whatsoever, past, present or future, foreseen or unforeseen, arising out of the use of, or reliance on, this Registry.

Terminology: Unless otherwise defined in this document, capitalized terms have the meaning assigned to them as per the UCCMS.

Purpose of the Registry: The Registry is a searchable database of Participants whose eligibility to participate in sport has in some way been restricted due to provisional measures and/or sanctions imposed, for purposes of carrying out the objectives of the UCCMS, the Physical Activity and Sport Act, Abuse-Free Sport and the mandate received by the SDRCC from the Government of Canada for preventing and addressing maltreatment in sport, in accordance with applicable laws (the "Objectives"). Provisional measures and sanctions are applied as part of or as a result of the Abuse-Free Sport complaint management process.

The Registry is necessary to meet the Objectives, including advancing a respectful sport culture that delivers quality, inclusive, accessible, welcoming and safe sport experiences, as per the objectives of the UCCMS. Individuals should have the reasonable expectation when they participate in sport in Canada that it will be in an environment that is free from all forms of Maltreatment and that treats every individual with dignity and respect.

To further these Objectives, relevant information contained on the Registry is publicly searchable.

Limitations: The OSIC and the SDRCC (including but not limited to their employees, agents, directors, legal successors/assigns and affiliates) make no warranty, representation or guaranty as to the content or completeness of the information provided in the Registry. The SDRCC (on behalf of the OSIC) expressly disclaims any and all liability for any loss or injury caused, in whole or in part, by its actions, omissions, or negligence in procuring, compiling or providing the information contained in the Registry, including without limitation, liability with respect to any use of this Registry, or the information contained herein. Reliance on the information contained in this Registry is solely at your own risk. The information may change or be modified at any time. Any individual who believes that information contained in this Registry is not accurate should contact the OSIC by emailing: admin@osic-bcis.ca.

Permitted use: The Registry may not be used for commercial purposes. It must be used for the purpose of carrying out the Objectives and fostering a safe sport environment.

It may be a Prohibited Behaviour under the UCCMS, or in contravention of other OSIC policies and procedures, criminal laws, civil laws, and/or any applicable legislation or statute, to use Registry Information to threaten, coerce, intimidate, or harass any relevant Participant, including those listed herein, their family members, their entourage or other related person. For more clarity, such conduct is strictly prohibited and is construed as an unauthorized use of the Registry.

Intellectual Property: The Registry is the SDRCC's sole property (on behalf of the OSIC). All right, title, and interest, including any intellectual property rights evidenced by or embodied in, attached, connected, and/or related to the Registry (and any and all improvements, customizations, modifications and derivative works thereof) and any other deliverables or services provided by the OSIC, are and shall remain owned solely by the SDRCC (on behalf of the OSIC). Access to the Registry does not convey to YOU or any other party any interest in or to the Registry other than a limited right to access and/or use the Registry in the manner specified above. Nothing herein constitutes a waiver of the SDRCC's (on behalf of the OSIC) intellectual property rights under any law.

Overarching Policies: These terms and conditions do not form part of, override or replace (i) the UCCMS, (ii) the OSIC Policies and Procedures, including the Policy regarding the Abuse-Free Sport Registry, (iii) the Office of the Sport Integrity Commissioner Service Agreement between relevant Program Signatories and the SDRCC, (iv) relevant professional standards and obligations, or (vi) applicable laws (altogether the "Overarching Policies"). The Overarching Policies may also include terms and conditions that apply to your access and use of the Registry.

General: If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of the OSIC and/or SDRCC to enforce any of the provisions set out in these terms and conditions or Overarching Policies, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these terms and conditions or of any Overarching Policies or any part thereof, or the right thereafter to enforce each and every provision.
